Privacy Policy

SendWork Inc. (“we,” “us,” “our,” or “SendWork”) operates a network platform, which includes our mobile application, website https://www.sendwork.com, social networking pages (collectively, the “Site”) and various content, features, applications, products, and services available via the Site and/or in connection with our network platform (“Services”). The Site and Services are collectively referred to as the “SendWork Platform.”  We respect the privacy of the data collected from independent, self-employed individuals and/or businesses (“Providers”) willing and able to perform independent contractor and freelance services (“Jobs”), the clients (“Clients”) desiring to hire Providers to perform Jobs, vendors, and other users of the SendWork Platform, whether personally or on behalf of an entity (“you,” “your,” “User,” or “Users”). This privacy policy explains how we collect, use, disclose and safeguard your information when you use the SendWork Platform.  Please read this privacy policy carefully.  IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, DO NOT DOWNLOAD THE SITE, ACCESS THE SERVICES, OR OTHERWISE USE THE SENDWORK PLATFORM.

Each time you use the SendWork Platform, you agree to be bound by and comply with all of the terms of this privacy policy.  From time to time, we may update this privacy policy, at our sole discretion.  We will update the “Revised” date of this policy when we make changes.  Your use of the SendWork Platform after a revised privacy policy becomes effective will indicate your acceptance.  Therefore, we encourage you to frequently review this privacy policy to help ensure that you are informed of our current privacy practices.

Information We Collect

We may collect information about you in a variety of ways. This privacy policy does not apply to the third party mobile application online stores from which you download the Site. Such app stores may also collect and use information about you and you may be subject to their privacy policies and terms of use. In addition, this privacy policy does not apply to the third party payment processor or money transfer agents used to make payments for Jobs.  We are not responsible for the data collected by such third parties. The information we may collect depends on your use of the SendWork Platform and includes, but is not limited to the following types of information:

Personal Information.  By using the SendWork Platform, we may collect contact details, demographic data, and other personally identifiable information (such as name, mobile phone number, email address, work history, and taxpayer identification number) that you voluntarily provide to us as part of the registration process, when you contact us, or when you participate in the Services (such as when you sign up for newsletters, enter contents, apply for promotional cards and vouchers, or complete surveys).  If you choose to share information about yourself via interactive areas of our Site, please be advised the information you disclose in these areas is public information and will be accessible to anyone who accesses the SendWork Platform.

Payment Details.  In connection with the payment of Jobs, we may collect data related to your payment method (e.g. card brand, expiration date).  We do not, however, view or store your credit card information.  This is handled by third-party payment processors.

Mobile Device Information.  When you access the Site from a mobile device, our servers may automatically record information that your mobile device transmits, including your device name and type, your device ID number, version of your operating system, access times, browser information, user settings, your geographical location, and information about your use of the Services, such as your interactions with the other Users via server log files. Information may also be collected via mobile device IDs and other similar tracking technologies to recognize you.

Location Information.  If you use the SendWork Platform, we may access your generic location (such as city or neighborhood) data, or, with your consent, your geolocation data, which, if enabled, may be received by us every time you use the SendWork Platform.  We may use and store this location information to provide and improve features of our Services, for example, to provide you more relevant content about Jobs and Providers in your neighborhood, and geolocation information enables location of the Job site.

Verification and Background Information.  Some data we collect is publicly available.  We may also collect data about you from other entities.  By gathering additional data about you, we can correct inaccurate information, enhance the security of your transactions, and provide recommendations and special offers that may be of interest to you.  Additionally, we check the backgrounds of each Provider using a third-party background check service that includes, but is not limited to a national criminal record check. These checks include but are not limited to, verification of identification and criminal record background checks at the national level. Providers hereby grant SendWork their express consent to conduct and perform such background checks as required or deemed appropriate by SendWork. These checks will be in compliance with federal and state laws, including the Fair Credit Reporting Act.

Information We Use

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience.  Specifically, we may use information collected about you in connection with the SendWork Platform to:

Ensure Users are provided with the Services in a timely manner.

Identify, authenticate, and bill Users for use of the Services.

Increase the efficiency and operation of the SendWork Platform.

Monitor, analyze, and computer usage and trends on the Site and to improve your experience with the SendWork Platform.

Request feedback, conduct surveys and otherwise contact you about your use of the SendWork Platform.

Notify Users of any news or developments regarding the Services and to deliver targeted advertising to Users.

Compile anonymous statistical information and analysis for use internally or with third parties.

Enable User-to-User communications and post your comments, ratings, and reviews.

Detect, prevent, or investigate security breaches, fraud, or other illegal activity in connection with the SendWork Platform and enforce the Terms and Conditions for Users.

Maintain appropriate records for internal administrative purposes.

Information We Share

We may share information we have about you as follows:

With Third Party Services.  We may share your information with third parties that perform services for us or on our behalf, including payment processors, background service check firms, data analytic services, email delivery vendors, hosting services, geolocation application programming interface services (e.g. Google Maps), telecommunication companies, and wireless service providers.

To Protect Lawful Interests.  If we believe the release of information about you is necessary to respond to legal process or a request for information, we may share your information as permitted or required by any applicable law, rule, or regulation or as necessary to investigate or remedy potential violations of our policies or to protect the rights, property, and safety of others.  This includes exchanging information with other entities for fraud protection and credit risk reduction.

Your Public Posts. We support and encourage you to interact with other Users of the SendWork Platform.  When you use interactive features of our Services, your comments, ratings, reviews, and photos may be viewed by all Users and may be publicly distributed outside our Site.

With Other Users.  In order to provide the Services, when a Provider is willing and able to perform a Job, we will display certain information about the Provider to the Client who requested the Job, including Provider’s name, photograph, and rating.  When a Client submits a request for the performance of a Job, we will display certain information about the Client to Providers, including the Client’s name, address, and rating.

With Advertisers and Marketing Firms.  Our Services may be supported by third-party advertising services or networks that post advertisements on the Site.  These third-party advertising services or networks use technology to send, directly to your mobile device, the advertisements, and links that appear in connection with the SendWork Platform.  They automatically receive your IP address when this happens.  They may also use tracking technologies to measure the effectiveness of their advertisements and to personalize the advertising content to you.  We also may share your data with marketing firms to assess, develop, and provide you with promotions and special offers that may be of interest to you, administer sweepstakes and events, or for other promotional purposes.

Anonymized Data.  We may share your information in a way that does not directly identify you.  For example, we may share data about your use of our SendWork Platform in a way that does not identify you or may combine data about the nature or frequency of your transactions with similar information about other users and share the aggregated information for statistical analysis and other business purposes.

For Our Business Transactions.  If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity.  If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party.

Interactive Features. You may be able to participate in certain activities via the Site that gives you the opportunity to communicate or share information not just with us, but also with other users of the SendWork Platform.  These activities include posting comments, ratings, reviews, and photos.  You understand that when you use the SendWork Platform, the information you post on interactive areas, as well as information you share with specific Users may be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages.  We cannot control who reads your posts or what other Users may do with the information you voluntarily post, so we recommend you be cautious about sharing personal information in online forums.  We are not responsible for the actions of third parties with whom you share personal information and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly. YOU ACKNOWLEDGE AND AGREE THAT YOU WILL ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM YOUR VOLUNTARY DISCLOSURE OF PERSONALLY IDENTIFIABLE INFORMATION.

Information Security

We use administrative, technical, and physical security measures to help protect personally identifiable information.  While we have taken reasonable steps to make the personal information you provide to us as secure as possible against unauthorized access, please be aware that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other types of misuse.  Any information disclosed online can potentially be intercepted and used by unauthorized parties.  To help ensure security via the Internet, we recommend you keep your browser up to date with all current security patches, use a unique username and password that you do not share, and prohibit anyone else from accessing your profile.

Cookies and Tracking Technologies

The SendWork Platform may use flash cookies, persistent cookie, session ID cookies, web beacons, pixels tags, and other tracking technologies depending on the features offered.  Log files, tags, and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the Site, and understanding how Users use the SendWork Platform. Cookies can also help us customize the SendWork Platform and improve your experience.  When you use the SendWork Platform, your personal information is not collected using tracking technology. However, if you previously provided personal information, tags may be tied to such information.  Aggregate cookie and tracking information may be shared with third parties.  Also, some content on Site may be provided by third parties that may uses cookies in conjunction with other tracking technologies to collect information about you when you use the SendWork Platform, which enables them to provide targeted advertising to you.  We do not control these third parties’ tracking technologies or how they may be used.  We may display certain adverting offers on our Site or allow third-party services, advertisers, advertising networks, or other third parties to advertise on Site.  Additionally, we may use third-party software to serve ads on our Site, implement email marketing campaigns, and manage other interactive marketing initiatives that may be used in connection with the SendWork Platform.  This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience with us.  For more information about interest-based ads, visit www.aboutads.info/choices.  Most browsers are set to accept cookies by default.  You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the SendWork Platform.

IP Address Monitoring

An Internet Protocol Address is an automatic number provided by the User’s internet service provider that is assigned to User’s computer (“IP Address”).  SendWork and third parties who perform services for or on our behalf may collect your IP Address when you use the SendWork Platform.  Our servers automatically store your IP Address when you log onto the Site.  Your IP Address is identified by the server and the server keeps track of your time, pages you visit, and the number of visits to the Site. Through our server that contains Users’ IP Addresses, we monitor the regions from which you use the SendWork Platform and we may also use IP Addresses to detect and monitor fraudulent activity.

Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have information about your online browsing activities monitored and collected. The Site does not track your browsing activities across third party websites and we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your preference not to be tracked online.  No uniform technology standard for recognizing and implementing DNT signals has been finalized.  Because there is not yet a common understanding of how to interpret the DNT signal, we do not currently respond to DNT signals which may be sent from your mobile device or any other mechanism that automatically communicates your choice not to be tracked online.  If a standard for online tracking is adopted that we must follow in the future, we will provide information about that practice in a revised version of this privacy policy.

Market Research and Choice to Opt-Out

SendWork may use, analyze, and aggregate personally identifiable information about you and your web usage as well as navigational data based on your interests for market researching purposes (“Market Research”). Users selected through Market Research may receive PERSONALIZED OFFERS FROM SENDWORK OR THIRD PARTIES THAT PROVIDE SERVICES FOR OR ON BEHALF OF SENDWORK BY PHONE, TEXT, EMAIL, FAX, OR OTHER BUSINESS CONTACT METHOD (“MARKETING COMMUNICATIONS”). A User may opt-out of receiving Marketing Communications.  If you wish to opt-out of receiving Marketing Communications from us, you may do so during the registration process (and later by editing the marketing preferences in your profile).  After logging onto the Site, click on your profile on the top right of any page, select “Notifications,” click on “email alerts,” and make your selections.  Even after opting-out, you may continue to receive marketing materials from third parties to whom we have already provided your email information.  You will be responsible for directly contacting such third parties to request cessation of further marketing materials.

Contests, Sweepstakes, and Surveys

From time to time, we may offer you the opportunity to participate in contests, sweepstakes, and other promotional activities.  Any information submitted in connection with such promotional activities will be treated in accordance with this privacy policy. We may also ask you to participate in surveys designed to help us improve the SendWork Platform.  Any personally identifiable information provided to us in connection with any survey will be used only in relation to that survey and will be disclosed to third parties not bound by this privacy policy only in aggregated or anonymous form.

Third Party Advertising

The SendWork Platform may contain advertisements from third parties that are not affiliated with us and which may link to other websites, online services or mobile applications.  We cannot guarantee the safety and privacy of information you provide to any third parties.  Any information collected by third parties is not covered by this privacy policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from our Site.  If you have questions about how these third parties use your information, we encourage you to review their policies and contact them directly.

Links to other Websites

The SendWork Platform may contain links (e.g. data or content exchange interfaces) to external services or websites of our partners or advertisers for purposes of information or functionality of our Services.  If you choose to visit an external service or website from our Site by clicking on or selecting a button, service, banner ad, or other types of advertisement, or clicking on another third party link, you will be directed to that third party’s website.  The fact that we may link to or incorporate a third party’s services, functionality, or website, or present a banner ad or other type of advertisement, is not an endorsement, authorization, or representation of our affiliation with that third party, nor is it an endorsement of the privacy or information security practices or policies of such third party. We do not exercise control over third party services, functionality, websites, or other resources, including their use of your personal information, and you should exercise caution when deciding to disclose any personal information to a third party.  These other parties may place their own cookies or other files on your computer or mobile device, collect data, or solicit personal information from you.  Other services follow different rules regarding the use or disclosure of the personal information you submit to them.  This privacy policy applies only to the SendWork Platform and we are not responsible for the privacy practices or the content of other websites.

Editing and Deleting Your Information

If you believe any information we have about you in your account is incorrect or incomplete, you may update or delete your information in your account yourself.  To edit your information, log into the Site and go to “My Account” at the top of the page. Please note, if you completely delete all of your information, your account may become deactivated. Certain information cannot be changed by you, such as your age.  If you believe any information we have about you is incorrect and you cannot change it yourself, contact us via the “Support” tab located on all pages of the Site. Personally identifiable information about Users made available to us or through the SendWork Platform will be retained in our databases for as long as deemed appropriate by SendWork.  For example, we will retain some personal information to help prevent fraud, to troubleshoot problems, to assist with any investigations, and to comply with legal requirements.  Additionally, we may keep a history of changed information to investigated suspected fraud with your account.  Therefore, you should not expect that all your personal information will be completely removed from our databases in response to your requests.

Policy for Children

The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under the age of 13 years of age.  We do not knowingly solicit information from or market to children under the age of 18.  If we learn that personally identifiable information from users less than 13 years of age has been collected, we will take reasonable measures to promptly delete such information from our records; however, please be aware that the information may not be completely or comprehensively removed from our databases.  If you are the parent or legal guardian of a child under 13 years of age who has transferred personal information via the SendWork Platform, please contact us using our contact information below to have your child’s information deleted.

International Transfer

Your information may be transferred to, and maintained on, computers or systems located outside of the state or country where the information was originally collected.  The privacy laws may not be as protective as those in your jurisdiction.  If you are located outside the United States and choose to provide information to us via the SendWork Platform, we may transfer your information to the United States and process it there. Your submission of such information represents your agreement to that transfer.
